The term "You" as used herein refers to all individuals and/or entities accessing any think-cell Web Sites and other websites provided by think-cell, which are mentioned explicitly in this Privacy Policy using think-cell's products, contacting think-cell or think-cell Software or being contacted by think-cell or think-cell Software for any reason or else interacting with think-cell.
Legal Basis
There are special provisions regarding the protection of personal data, in particular the German Federal Data Protection Act (Bundesdatenschutzgesetz – BDSG) and the Regulation (EU) 2016/679 (General Data Protection Regulation – GDPR). think-cell will process personal data strictly in accordance with these provisions. According to these provisions, think-cell is legally obligated to provide You with the following information.

Personal data collected by think-cell
When You access and use the Web Sites, interact with think-cell, use think-cell's products, contact think-cell or are being contacted by think-cell for any reason or else interact with think-cell, think-cell may collect certain information ("Your Data") in accordance with this Privacy Policy. The collection, storage, use and any other form of processing Your Data by think-cell occurs exclusively in the interest of think-cell's business operations. think-cell will not sell, transmit, disseminate or else disclose Your Data for any other purpose.
Use of think-cell’s Web Sites
The information that may be collected by automated means includes:
- Approximate location information if allowed by Your web browser settings
- Details about the devices that are used to access our Web Sites (such as the IP address and type of operating system and web browser)
- Dates and times of visits to and use of our Web Sites
- Information about how our Web Sites are used (such as the content that is viewed on our Web Sites and how users navigate between our web pages)

The legal basis for the temporary storage of these data is Art. 6 Para. 1 f) GDPR, as this processing is necessary to safeguard our legitimate interests in order to be able to operate the website, to enable the Web Sites to be delivered to Your device, to optimize the Web Sites and to ensure the security of our information technology systems. Our legitimate interest in data processing lies in these purposes.
The data will be deleted or anonymized 26 months after the collection.
Cookies and other Tracking
We use first party and third party cookies for several reasons. Some cookies are required for technical reasons that are strictly necessary for our Websites to operate, and we refer to these as "Strictly Necessary" cookies. To help think-cell analyze how users in general, including You, use the Web Site, think-cell uses Matomo (formerly known as Piwik), an open-source software for web analytics. The information about Your use of the Web Site (including Your IP address anonymized prior to its storage) so collected will be stored on think-cell's servers in Germany, will and can only be accessed by think-cell and will be used for analytical purposes to improve the experience of Web Site users, the content provided and the Web Site’s design. You can dissent to the collection of this information by adjusting Your browser settings to disallow tracking ("Do Not Track") or - in case you have not done so already - by clicking on the respective button below ("opt-out"). The think-cell Websites may uses the platform YouTube for some embedded videos. think-cell has made sure that no data is transferred to this service unless and until such an embedded video is played; furthermore, the "privacy-enhanced mode" offered by YouTube has been enabled. Once You play an embedded video, Cookies may be placed and Your Data may be tracked and processed by Google LLC, the operating company of YouTube. According to Google LLC, the information in particular serves the purposes to record video statistics, to improve user-friendliness and to avoid improper actions. Solely responsible for these Cookies and for the processing of Your Data in relation to the playback of videos is Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; if You want to ensure that Google LLC does not receive Your Data, do not click on the embedded videos on the Web Site. The legal basis for the use of the YouTube is your consent in accordance with Art. 6 (1)(a) GDPR, § 25 (1) TTDSG. The recipient of the collected data is the Google LLC. Vimeo
We use Vimeo a service provided by Vimeo.com Inc., 555 West 18th Street, New York, New York 10011, USA (“Vimeo”) for embedding videos about our products and services.
The legal basis for the use of the Vimeo is your consent in accordance with Art. 6 (1)(a) GDPR, § 25 (1) TTDSG. The recipient of the collected data is Vimeo. Personal data will be transferred to the USA under standard contractual clauses as defined in Art. 46 (2)(c) GDPR that act as appropriate guarantees for the data transfer.

If You contact us by phone or by email or via a contact form (if provided) we store Your personal data that You submit (e.g. the email-address or phone number, name and contact details and other information that You provide).
If You contact us within an existing contractual relationship or contact us in advance for information about our scope of services or other services, the data and information You provide will be processed for the purpose of processing and answering Your contact request in accordance with Art. 6 Para. 1 S. 1 lit. b) GDPR, in any other cases to protect our legitimate interests in accordance with Art. 6 Para. 1 S. 1 lit. f) GDPR for the purpose of properly answering customer/contact inquiries.
The transmitted data will be stored until the purpose for data storage/processing ceases to exist (e.g., after Your inquiry has been processed). Mandatory legal provisions - in particular retention periods - remain unaffected.
User Account
For the following processing think-cell Software is responsible:
If You choose to purchase the think-cell software we store your personal information provided in your user account. The following data will be stored: salutation, name, phone number, email-address company, country, industry, company number of employees. The purpose of the processing is to enable You to administer the software. The legal basis of the processing is Art. 6 Para. 1 S. 1 lit. b) GDPR.
The data is retained for as long as you continue to be a user of the think-cell software and for a period of up to 12-months after this.
Test Version
For the following processing think-cell Software is responsible:
If You request to use a test version of the think-cell software via our Web Sites we store your personal information provided. The following data will be stored: salutation, name, phone number, email-address company, country, industry, company number of employees. The purpose of the processing is the fulfilling of the agreement on the testing of the software (Art. 6 Para. 1 S. 1 lit. b) GDPR).
The data are deleted if you have not become a think-cell customer or engaged with think-cell employees or think-cell communications for a period of 12-months.
Use of think-cell’s Products
For the following processing think-cell Software is responsible:
When You use the Software, think-cell does not intentionally collect or process Your personal data. think-cell has no means to remotely access Your computer or any of Your Data through the Software, including when providing customer support.
However, some data that are processed may be considered personal data:
Error Reports
The Software does, provide a feature to send automated error reports to think-cell when an error condition arises to help improving the Software's stability and robustness. While these error reports do generally not contain any of Your personal data, in certain circumstances it is conceivable that certain information sent could be considered as personal data. think-cell will only process these error reports for their intended purpose, i.e. identifying and addressing possible errors of the Software.
The legal basis for the processing is, therefore, the fulfillment of the software license agreement (Art. 6 Para. 1 S. 1 lit. b) GDPR). For further information on the content of error reports and on how to disable this feature, please refer to the Software's documentation at Error reporting.
The data are deleted after 2 years.
think-cell Send with Gmail
The Software provides a feature to allow users to send slides with Gmail ("think-cell Send with Gmail"). This feature involves use of the Google Sign-In service that may collect information used to identify You. Solely responsible for the processing of Your Data in relation to the Google Sign-In service and to Gmail is Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; if You want to ensure that Google LLC does not receive Your Data, do not enable think-cell Send with Gmail as the default setting to create and edit e-mails or do not use the feature think-cell Send with Gmail.
If You use the feature think-cell Send with Gmail, the Software will locally access and use Your Google user data (i.e. Your Gmail address) to create a draft email; no Google user data will be shared or stored (with the exception of, for purely technical reasons, a so-called OAuth2 refresh token) by the Software, and none of Your Google user data will be collected, stored or else processed by think-cell at any time. think-cell's use of the aforementioned information received from Google APIs will adhere to Google API Services User Data Policy, including the Limited Use requirements. Information received from Google APIs will not be transferred to any other app.
The legal basis for the processing is, therefore, the fulfillment of the software license agreement (Art. 6 Para. 1 S. 1 lit. b) GDPR).
We point out that a data transfer to so-called unsafe third countries may take place. An adequate level of data protection is ensured by standard contractual clauses according to Art. 46 (2) lit. c DSGVO and further contractual measures.
Authentication uses OAuth2. think-cell stores the access token encrypted with the user token in the computer user’s profile. think-cell does not have access to the token, and refresh the token as needed.

The Software provides a feature to allow users to directly embed images from Getty Images into Microsoft PowerPoint. When using this feature, an internet connection to Getty Images (US), Inc. or one of its affiliates is established. Getty Images (US), Inc. or one of its affiliates will collect information to identify You and process Your access to images offered by Getty Images. Solely responsible for collecting and processing Your Data in relation to connecting to and using Getty Images is Getty Images (US), Inc., 195 Broadway, 10th Floor, New York, NY 10007, USA, or one of its affiliates. If You want to ensure that Getty Images does not receive Your Data, do not use the respective feature. The Software does not transfer Your Data to Getty Images (with the exception of a token that stores authentication data), and no Getty Images user data will be collected, stored or else processed by think-cell at any time.

Tableau Software, LLC or one of its affiliates will collect information to identify You and process Your access to chart data offered by Tableau. Solely responsible for collecting and processing Your Data in relation to connecting to and using Tableau is Tableau Software, LLC, 1621 N 34th St., Seattle, WA 98103, USA or one of its affiliates. If You want to ensure that Tableau Software, LLC or one of its affiliates does not receive Your Data, do not use the respective feature. The Software does not transfer Your Data to Tableau Software, LLC or one of its affiliates (with the exception of a token that stores authentication data), and no Tableau user data will be collected, stored or else processed by think-cell at any time.

GUID and License Key
When You use the Software, usage data (launching Microsoft PowerPoint, selection and use of PowerPoint functions and/or think-cell add-in functions) ("Usage Data") will be transmitted to think-cell together with an anonymous Globally Unique Identifier ("GUID") and the license key used and evaluated by think-cell. The Usage Data does not contain any content data (such as names, addresses and entered numeric variables) and is only stored on think-cell servers. The GUID is created when using think-cell for the first time and stored together with the user’s settings. It is a random string with no connection to the machine, user or document current at the time of creation. Using the GUID, it is only possible to determine whether two requests came from the same or from different users. Together with other information, this could make it possible to draw conclusions about the user. Usage Data is not collected and analyzed if You have deactivated the error report and automatic update functions.
The legal basis for the processing is, therefore, the fulfillment of the software license agreement (Art. 6 Para. 1 S. 1 lit. b) GDPR).
The bug report created from the GUID is stored indefinitely. However, the personal information the bug report is created from, such as IP address, is not retained or associated with the bug report.
Your rights
- You are entitled to obtain from think-cell free-of-charge confirmation as to whether or not personal data concerning You are being processed. Where this is the case, You are further entitled to obtain access to the personal data and additional information in accordance with art. 15 GDPR.
- In case personal data concerning You is inaccurate or incomplete, You have the right to obtain rectification or completion. In the instances covered by art. 17 and art. 18 GDPR, You are entitled to request the erasure or the blocking / restriction of processing of data.
- You have the right, for reasons that arise from Your particular situation, to object at any time to the processing of personal data relating to You, which is based on Art. 6 Para. 1 e) or f) GDPR; this also applies to profiling based on these provisions. We will no longer process Your personal data unless we can prove compelling legitimate reasons for the processing that outweigh Your interests, rights and freedoms, or the processing serves to assert, exercise or defend legal claims.
- Furthermore, You are entitled to request in accordance with art. 20 GDPR the transmission of personal data concerning You and provided by You to You or directly to another data controller.
- Where processing Your Data is based on Your consent, You have the right to withdraw Your consent at any time, without affecting the lawfulness of processing based on Your consent before its withdrawal.
- If You consider that the processing of personal data relating to You infringes applicable law, You have the right to lodge a complaint with a supervisory authority. Such complaint will not prejudice any other administrative or judicial remedy. 7. 外国にある第三者へのパーソナルデータの提供
当社は、第6項(3)に定めるEU外の当社グループ会社にお客様のパーソナルデータを提供する場合があります。その場合に参考となるべき国別の情報は、現時点において、次に掲げるとおりです。

当社は、パーソナルデータの漏えい、滅失又は毀損の防止その他パーソナルデータの安全管理のために、必要かつ適切な措置を講じます。当社が講じる安全管理措置については、「12.個人情報に関するお問い合わせ、苦情に関する受付け窓口」までお問合せください。

当社は、上記「3 パーソナルデータの利用目的について」記載の利用目的を果たすために必要な期間又は個人情報保護法その他法令によって要求される期間のみ、パーソナルデータを保存します。
